Officially Release on GB 41700-2022 National Mandatory Standard for Electronic Cigarettes

On April 12, 2022, Standardization Administration of the People's Republic of China official website issued No.4 National Standard Announcement which approves the release of mandatory national standard GB 41700-2022 for "Electronic Cigarettes". New standard will come into force from October 1, 2022. The release of the mandatory national standard for "Electronic Cigarettes" declares production without national standards for electronic cigarettes comes to an end. The standard requires all electronic cigarette products must be produced in accordance with the national standard and only 101 kinds of additives allowed by the national standard can be added. It is of great significance to the industry.

Abstract

1. Requirements on Lithium Battery Control

The mandatory national standard of "Electronic Cigarette" stipulates that lithium-ion batteries and battery packs in electronic cigarettes should meet identification and safety requirement of electronic industry standard SJ/T 11796 "General Specifications for Lithium-ion Batteries and Battery Packs for Electronic Cigarettes" , which issued by the Ministry of Industry and Information Technology of the People's Republic of China.

2. Requirements on Toxic and Hazardous Substances

The concentration of nicotine in the aerosol should not be higher than 20mg/g, and the total amount of nicotine should not be higher than 200mg. There is a strict regulation on the amount of formaldehyde, acetaldehyde and other substances released in electronic cigarette.

3. Requirement on Safety Protection

Electronic cigarettes should have child-proof activation and protection against accidental activation.

Q: What is the background and main content of the formulation of national standard for "E-Cigarette"?

A: In November 2021, the State Council issued "Decision on Amending the Regulations on the Implementation of the Tobacco Monopoly Law of the People's Republic of China" (Order No. 750 of the State Council). It adds Article 65 "Electronic cigarettes and other new tobacco products shall be implemented with reference to the relevant provisions”. On March 11, 2022, the State Tobacco Monopoly Administration formulated and released the "Administrative Measures for Electronic Cigarettes", which will be officially implemented on May 1. The measures proposed that "electronic cigarette products should meet the mandatory national standards for electronic cigarettes". Therefore, the formulation of mandatory standards for "E-cigarettes" is an important means to implement the above-mentioned laws and regulations, and it is also an important technical support for the establishment of an electronic cigarette supervision system.

On April 8, 2022, the State Administration for Market Regulation (Standard Committee) released the mandatory national standard GB 41700-2022 "Electronic Cigarettes". The standard is formulated by the State Administration for Market Regulation, together with the State Tobacco Monopoly Administration, and organized by the National Tobacco Standardization Technical Committee and related technical institutions. The standard mainly include these content. Firstly, clarify relevant terms and definitions of e-cigarettes and atomizers. Secondly, put forward principle requirements on the design and selection of raw materials of e-cigarettes. Thirdly, clarify technical requirement on emissions of e-cigarettes and responding trial method. Fourthly, stipulate requirement on signs and instructions of electronic cigarette products.

 

Q: What are the outstanding features of the technical content of the national standard of "Electronic Cigarette"?

A: The "Measures for the Administration of Electronic Cigarettes" prohibits the sale of flavored electronic cigarettes and electronic cigarettes that can add atomizers. Based on the regulatory requirements of the "Measures for the Administration of Electronic Cigarettes" and in line with international regulatory trends, the national standards for "Electronic Cigarettes" propose scientific and applicable technical content. Firstly, it defines electronic cigarettes as “Electronic delivery systems for the generation of aerosols for human smoking”. It takes nicotine-free electronic cigarettes into the definition of electronic cigarettes. Secondly, since flavored e-cigarettes such as fruit flavored, food flavored, beverage flavored and nicotine-free flavored e-cigarettes are highly attractive to juveniles and are easy to induce juveniles to smoke. The standard clearly stipulates that the characteristic flavor of the product should not display other flavors e-cigarettes expect tobacco flavor e-cigarettes. And clearly require that "aerosols should contain nicotine", means e-cigarette products do not contain nicotine shall not enter the market for sale. Thirdly, based on the principle of additives usage and after sufficient safety risk assessment , demonstration and experimental verification, the standard clearly lists 101 kinds of additives that are allowed to be used, which included in the "white list" of additives.

 

Q: The national standard for "E-Cigarette" will be officially implemented on October 1 this year. What are the considerations when setting the implementation date?

Answer: According to the relevant provisions of Article 25 of the "Standardization Law of the People's Republic of China", products and services do not meet the mandatory standards shall not be produced, sold, imported or provided. After the standard officially implemented, e-cigarette products sold on the market must meet national standards. Considering that after release of the national standard "E-Cigarette", e-cigarette manufacturers need to design products in compliance with the standard and complete product transformation, as well as apply with relevant departments for product testing and technical review. And all of these require time. So, a 5-month implementation transition period was set. During transition period, e-cigarette manufacturers should carry out standard implementation training and study standard content to achieve product compliance as soon as possible.
