The UK Packaging Act follows the principles of Extended Producer Responsibility (EPR). In the UK, any party that puts packaging into circulation must bear the cost of recycling and disposal of used packaging. The aim is to reduce waste and make recyclable materials reused, thereby protecting the environment.
What is the UK Packaging Act?
"Packaging" means any material used to secure, protect, handle, deliver and present the Goods. This includes the packaging of raw materials, all the way to the finished product that is sold or is being sold. Examples include pallets, boxes, bags, packing tape, rolls, tubes, and hangers that are sold as part of an apparel item. Applicable regulations: Packaging and Packaging Waste European Directive (94/62/EC).
Which goods need to be registered under the UK Packaging Act?
If your business or organization produces or uses packaging, or sells packaged goods into the UK market, you may be required to register with the UK Packaging Act.
Who needs to register with the UK Packaging Act?
Local companies in the UK:
If you (or a group of companies to which you belong) produced more than 25 tonnes (25-50 tonnes for small businesses and more than 50 tonnes for large businesses) of packaging material or packaging in the previous calendar year;
and you (or a group of companies to which you belong) had an annual turnover of more than £1 million in the last calendar year (1-2 million for small businesses, over 2 million for large businesses);
Non-UK based businesses:
if you (or a group of companies to which you belong) produced more than 50 tonnes of packaging material or packaging in the previous calendar year;
and you (or a group of companies to which you belong) had an annual turnover of more than £2 million in the last calendar year;

How to register the UK Packaging Act?
small companies:
You will need data on all empty and packaged goods handled and supplied through the UK market from 1 January 2023;
Register EPR for packaging online services from 2024;
Pay annual fees to environmental regulators from 2024;
Submit data on empty and packaged goods you have handled or supplied through the UK market in 2023.
Report once a year and submit the declaration data in the first quarter of the following year;
large enterprise:
You will need data on all empty and packaged goods handled and supplied through the UK market from 1 January 2023;
Register EPR for packaging online services from April 2023;
Pay annual fees to environmental regulators;
Buy patented or plastic items to meet your recycling obligations;
Submit data on empty and packaged goods that you handle or supply through the UK marketplace.
File twice a year, for example during January to June 2023, submitting data for the period 1 July 2023 to 1 October 2023.

You also need to register for the Plastic Packaging Tax if you:
10 tonnes or more of finished plastic packaging components expected to be imported into or manufactured in the UK within the next 30 days;
from 1 April 2022;
This will change on March 31, 2023, when you will need to review the last 12 months on the last day of the month .
If you manufacture or import plastic packaging components with less than 30% recycled plastic content;
The tax comes into effect on April 1, 2022 and is levied at a rate of £200 per tonne.
