On December 29, 2023, the Office of Environmental Health Hazard Assessment (OEHHA) issued a notice to update the California 65 Chemicals List. Bisphenol S (BPS) was listed in the California 65 Chemicals List due to female reproductive toxicity.
According to California Proposition 65, if the product contains added substances after the substances are listed, clear and reasonable warning signs shall be provided within one year, that is, the warning must be completed before December 29, 2024.
The new substance is as follows:

California 65 List is a list of chemicals known to cause cancer, reproductive system or other cumulative toxicity published by California and updated annually. This list, which must be updated at least once a year, has grown to include approximately 1000 chemicals since it was first published in 1987. California 65 does not set limits for hazardous substances in products, but can refer to existing litigation cases or agreements for relevant categories of products. Enterprises need to pay attention to the use of the chemicals in the list in products, especially the substances involved in previous cases and the new chemicals added by the list, and carry out supply chain investigations for these high-risk chemical substances, which can be tested if necessary.
Products containing the listed chemicals are required to affix warning signs according to the specified requirements, otherwise it may face lawsuits and huge fines.
