Royal Decree No. 110/2015 on Waste Electrical and Electronic Equipment (WEEE RD) was issued adapting Spanish regulations to Directive 2012/19/EU and Act No. 22/2011 on Waste and Contaminated Soil . The purpose of this Royal Decree is to reduce the generation of WEEE and to promote the reuse and valuation of electrical equipment through proper management of electrical equipment controls in an effort to avoid negative impacts on health and the environment. WEEE RD adheres to the principle of extended producer responsibility, so producers of electrical and electronic equipment (EEE) must bear the correct environmental costs . Manage future waste generated by the equipment it sells. Therefore, producers will implement the collection and management of waste generated by their electrical and electronic equipment and pay for the environmental management costs of their products when they become waste.
Which commodities need to be registered in Spanish WEEE ?
Electrical and electronic equipment refers to equipment that relies on electric currents or electromagnetic fields to function properly, and equipment used to generate, transmit and measure such currents and fields, with a rated voltage not exceeding 1000V for alternating current and 1500V for direct current.

Who needs to register with the Spanish WEEE and Batteries Act ?
1、All sellers who import electrical and electronic equipment from third countries to the Spanish market need to register the Spanish WEEE
2、Manufacture of electrical and electronic equipment : in Spain or abroad, provided the company is located in Spain and trades in Spain under its name or brand.
3、Resale in the EEA : Manufactured by third parties under their own brand , based in Spain.
4、Imports of electrical and electronic equipment : from another country or from another EU member state and its headquarters in Spain.
5、Distance sale of WEEE : by any means of direct communication with a domestic or professional user in Spain, even if it is located in another EU member state or in another country*
When is it mandatory?

If a product is non-compliant, it will be affected by:
1) Customs prohibit non-compliant electronic appliances, batteries and accumulator products from entering the market;
2) Unable to enter the customs, and the online sales platform may not be able to sell;
3) A fine of up to 1.75 million euros was imposed by the supervisory authority;
For Spanish WEEE, there is a fine for not registering with the Ministry of Industry. The penalty is to calculate the total sales volume and total weight of the products put into the market from the time the seller entered the Spanish market until now, calculate the unpaid fees and pay them back, and pay a certain amount of fines at the same time.
How to register Spanish WEEE ?
1. Submit the application form to become a member;
2. Submit the registration materials and sign the registration contract;
3. Wait for the registration to be completed, usually 1 week;
About declaration:
1. Report once per quarter. Before the 20th of the next month of the previous quarter, such as April 20, report the sales data from January to March, and report the previous quarter. 2. The quantity of WEEE put on the market (individuals) number and weight), submitted to the recycling company, which will declare on its behalf;
3. After the declaration is completed, the producer will receive a bill from the recycling company, and the producer must pay the recycling fee on a quarterly basis;

According to the requirements of Article 11(2) of EU Directive 2002/96/EC (WEEE): Manufacturers must use the "crossed out wheelie bin" symbol for electrical and electronic equipment placed on the market after August 13, 2005 to mark.
Basic principles of use:
◆The u sign must be clearly visible to ensure consumers can immediately recognize the symbol;
◆The u mark must be durable and indelible. After rubbing with a cloth soaked in water for 15 seconds, and then rubbing it with a cloth soaked in petroleum spirit for another 15 seconds, the mark should still be clearly legible;
◆The crossbar at the bottom shall consist of solid lines and must be used with a litter box, the height (h) shall be 0.3 a or 1 mm, whichever is greater;
◆size: maintain the size relationship shown in the left figure;
◆If the product cannot be printed with the logo due to size or function, it must be printed on the power cord and accompanying documents, or on the packaging if there is no accompanying document.
What do I need to do after registration is complete?
Step 1: Upload the registration number to the platform (A mazon , e Bay , A libaba , etc.), and continue to sell on the platform after passing the platform verification;
Step 2: Contact the local recycling company for filing and declaration;
Step 3 : Subsequent declarations shall be made every quarter every year .
