Starting from October 16, 2023, Amazon will officially implement Spanish Extended Producer Responsibility (EPR) regulations, including Spanish Packaging Law, Spanish Battery Law, and Spanish WEEE.
At the same time, sellers who comply with regulations must submit a valid Spanish EPR Packaging Law registration number on the Amazon platform before December 31, 2023. If the seller does not submit a valid packaging registration number to Amazon before December 31, 2023, the seller will automatically register for Amazon's "payment on behalf of" service.
According to the terms and conditions stipulated in the Extended Producer Responsibility (EPR) requirements policy for Spanish third-party sellers, through this service, Amazon will, on behalf of the seller, report to the relevant producer responsibility organization for the seller’s sales on the Amazon Marketplace in 2023 and beyond. Declare and pay the environmental protection payment, and deduct the corresponding amount from the seller's corresponding account. A service fee will also be charged.
Products requiring registration under the Packaging Act:
From a compliance perspective, all sellers selling electronic products, packaging products, and batteries and accumulators in the Spanish market must register and declare.
The main product categories covered by Spanish EPR are:
Single-use plastics, such as plastic boxes, plastic bottles, plastic wrappers, etc.;
Electrical and electronic equipment (EEE), such as lamps, etc.;
Batteries and accumulators, such as rechargeable batteries, industrial batteries, etc.;
Tires, such as automobile tires, but not bicycle tires;
Industrial oils, such as lubricants, etc.
AGC reminds:
If the Spanish EPR is not registered as required, the seller's non-compliant products will not be cleared for customs. And depending on the extent of the seller's violation , cross-border platforms such as Amazon will also block your products and restrict sales. At the same time, the seller will be fined up to 1.75 million euros by the regulatory authorities.
The comprehensive implementation of the EPR compliance policy in Europe has become a general trend. Based on this environmental protection policy, sellers and friends can register in advance for packaging laws, battery laws, WEEE and other related categories according to the requirements of their own business markets.
