Italy amends stainless steel regulation Release Time:2023-02-10

On 19 January 2023,the Italian Official Gazette published the revised Decree of the Ministry of Health No. 208 of 25 November 2022 (DECRETO 25 novembre 2022, n.208),The section on stainless steel products in contact with foodstuffs in the regulation 1973/3/21 "Hygienic regulations for packaging, containers and utensils in contact with foodstuffs or personal products" has been updated .The new Decree has been in force since 3 February 2023. 



Revised content

This revised decree for stainless steel updates Part A and Part B of the list of stainless steels in contact with foodstuffs, as follows:

(1) Part A had add a new Types of stainless steels authorized for use:

(2) Stainless steels that are not on the list of Part A authorisations are identified by chemical composition analysis. It is required to comply with the migration restrictions set out in Article 36 of the Ministerial Decree of 21 March 1973 and to meet the composition requirements of Part B. The new composition requirements are as follows:

Ω means provided that the articles made of the steel in question are intended exclusively for the manufacture of of kitchen and tableware intended for repeated short-term use at hot or room temperature.

Italian food contact stainless steel requirements

Stainless steel is widely used as a food contact material in various countries due to its good resistance to heat, corrosion and mechanical processing properties as well as its glossy and beautiful appearance,and Italy is one of the EU member states that pay the most attention to food contact stainless steel materials and have the most frequent market enforcement.The Italian Food Contact Decree 1973/3/21 compliance requirements for stainless steel products are as follows:

(i) Must meet the requirements of the list of permitted stainless steel grades;

(ii) Migration limits are specified: the overall migration limit is 8mg/dm2 and the migration of chromium, nickel and manganese must not exceed 0.1mg/kg respectively;

(iii) Migration test conditions are specified as:

70℃ for 30 minutes

In the case of objects for repeated use, of short duration at hot or room temperature, which can be used in contact with water only

AGC reminds: the requirements for food contact stainless steel products in Italy are stringent and companies should pay close attention to the changes in the standards and assess the overall migration (OM) and special migration (SM) of their products according to the latest testing requirements in order to enter the Italian market smoothly.
