The Austrian Packaging Act follows the principles of Extended Producer Responsibility (EPR). In Austria , any party that puts the packaging into circulation must bear the cost of recycling and processing waste packaging. The aim is to reduce waste and make recyclable materials reused, thereby protecting the environment.


What is the Austrian Packaging Act?

From January 1, 2023, all foreign companies supplying private end consumers by distance sales in accordance with the Austrian Consumer Protection Act (§ 5a KSchG ), e.g. via an online shop, must appoint an authorized representative in Austria for its packaging. The same applies to the traditional cross-border trade in goods, if a company without a registered office in Austria wishes to assume so-called packaging advance payment obligations for Austrian customers, as has been the case until now.

 

In addition, additional reporting obligations will be introduced, in particular for service packaging such as drink cups, tote bags, and products such as wet wipes, balloons or tobacco products, for which additional costs will have to be paid from 2023.


Which goods need to be registered under the Austrian Packaging Act?


According to the Austrian packaging law, packaging subject to systematic participation in recycling is usually packaging that is discarded by the final individual buyer. Such packaging includes retail packaging, combination packaging, service packaging, and shipment packaging. The shipping packaging is used to protect or secure the product during storage and transportation, but is not intended for use by the final buyer. Shipping packaging includes cardboard boxes for grouping and bundling merchandise and film wrapping around beverage cans, bubble wrap or cardboard shipping pallets.

 
The following products are also regulated:

◆Disposable crockery and cutlery;

single-use plastic products;

fishing gear;

 

Who needs to register with the Austrian Packaging Act?

You are considered a producer if you are the first to place the packaging (for packaging goods) in Austria for commercial purposes.

Producer usually refers to the manufacturer responsible for the production and packaging of the product

Producers may also include retail companies that distribute private label products in any of the following situations:

(1) The product is packaged by a third party on behalf of the retail company;

(2) Only the name or brand of the retailing company is marked on the package.

If the importer needs to bear legal responsibility for the goods in transit, it means that the importer is also the producer.

The online retailer who is the first to pack the goods for delivery is also considered a producer.
