On September 1, 2022, the U.S. Consumer Product Safety Commission (CPSC) has published a direct final rule to revise the regulation 16 CFR 1230 Safety Standard for Frame Child Carrier. The rule is effective on December 3, 2022, unless CPSC receives a significant adverse comment by October 3, 2022.
Each Frame Child Carriers shall comply with the ASTM F2549-22 Standard Consumer Safety Specification for Frame Child Carriers. The previous version of 16 CFR 1230 referenced ASTM F2549-14a.
A laboratory is not required to resubmit their CPSC application if the laboratory is already CPSC-accepted for 16 CFR PART 1230. The CPSC Committee considers that the existing CPSC-approved ASTM F2549-14a testing laboratory can also perform tests in accordance with ASTM F2549-22.
A frame child carrier is a product, normally of sewn fabric construction on a tubular metal or other frame, which is designed to carry a child, in an upright position, on the back of the caregiver. A frame child carrier is intended for use with a child that is able to sit upright unassisted and weighs between 16 and 50lb (7.3 and 18.1 kg).
Frame child carrier exported to the United States need to provide a Children's Product Certificate (CPC) to demonstrate compliance with the appropriate CPSC safety regulations. The CPC certificate and supporting test report must be in English. The CPSC safety regulations that the frame child carrier needs to meet are:
1. CPSIA section 101 or 15 USC 1278a: Total Lead Content.
2. CPSIA section 103: Tracking labels for children product.
3. CPSIA section 108 and 16 CFR Part 1307: Prohibition of Children's Toys and Child Care Articles Containing Specified Phthalates.
